Independent
(Skilled Worker)
Who
They are persons who are applying to immigrate to Canada
based upon their personal skills and ability to contribute
to the Canadian economy.
Skilled worker immigrants are chosen for their ability to
become successfully established in Canada. The Immigration
and Refugee Protection Act introduces new selection criteria
with more emphasis on applicants' education and such flexible
skills as language rather than on their intended occupation.
Since the implementation of the Immigration and Refugee
Protection Act (IRPA) and until September 18, 2003, the pass
mark was 75. The Minister of Citizenship and Immigration Canada,
Denis Coderre, has adjusted the pass mark in response to Canada's
need for skilled workers. Effective immediately, all new skilled
worker applicants and those currently in the system who have
not yet received a selection decision will be assessed with
a pass mark of 67.
. These points are allocated to a number of selection criteria
including:
- age. (Max: 10 Points)
- education (Max: 25 Points)
- work experience. (Max: 21 Points)
- occupation arranged employment/study in Canada. (Max:
10 Points)
- ability to speak English ( IELTS Test ) and french (Max:
24 Points)
- adaptability (Max: 10 Points)
The visa officer also must be satisfied that the immigrant
and all of his dependents are not inadmissible to Canada for
criminal or medical reasons. The immigrant must also show
that they have sufficient funds. This is VERY IMPORTANT as
financial assistance is NOT AVAILABLE for new immigrants.

Entrepreneur
They are persons who:
a) have a net worth of at least $300,000 CDN;
b) have business experience (see minimum requirements below)
(i) ownership of a qualifying business of a sufficient size;
or
(ii) management of a business, or a portion of a business
with a substantial number of employees; and
c) intend and will be able to for a period of at least one
year within the three years after the day the entrepreneur
becomes a permanent resident that
(i) control a percentage of the equity of a qualifying Canadian
business equal to or greater than 33 1/3 per cent;
(ii) provide active and ongoing management of the qualifying
Canadian business; and
(iii)create at least one full-time job in that business for
either a Canadian citizen or permanent resident, other than
entrepreneur and their family members.
Entrepreneurs must also obtain a minimum of 35 points when
assessed on the following criteria:
- business experience
- age
- education
- proficiency in English and French
- adaptability
Entrepreneurs are required to regularly report to an immigration
officer to show efforts made to meet terms and conditions
attached to conditional permanent residency visa.

regarding ownership and management of a business and the necessary

Self Employed
They are persons who have the intention and ability to create
their own employment by:
a) making a significant contribution to the cultural or artistic
life of Canada or to athletics in Canada at the world-class
level; or
b) purchasing and managing a farm in Canada.

Investor
They are defined as persons who:
a) have a net worth of $800,000 CDN (includes assets of the
person's spouse);
b) have business experience (see minimum requirements below)
(i) ownership of a qualifying business of a sufficient size;
or
(ii) management of a business, or a portion of a business
with a substantial number of employees; and
c) intend to make or have made an investment of $400,000
CDN to the Receiver General of Canada.
Financing of this payment can be obtained through certain
Canadian Deposit Insurance Corporation-approved organizations.
Investors must also obtain a minimum of 35 points when assessed
on the following criteria:
- business experience
- age
- education
- proficiency in English and French
- adaptability

Family Class
Who
Persons who wish to be reunited with close family relatives
in Canada may apply using this method.
The sponsor:
- is the person who wishes to help the relative immigrate
to Canada
- must be a Canadian citizen or permanent resident
- must be aged 18 years or older and
- must be living in Canada
The person who wishes to be sponsored must be a member of
the family class and includes:
- the sponsor's spouse
- the sponsor's common-law partner
- the sponsor's conjugal partner
- the sponsor's father or mother
- the sponsor's dependent son or daughter
Dependent children now include children under 22 years of
age.
How
Applicants are not assessed under the points system.
The person being sponsored must meet the basic standards
of good health and character.
The sponsor must sign an undertaking (a guarantee) with the
government of Canada to provide for the housing, care and
maintenance of the applicant and accompanying dependents.
The sponsor must satisfy an immigration officer that he or
she has sufficient income to support the members of the family
class whose applications are being sponsored.
The sponsored family member must not be found to be within
any of the inadmissible (ie. criminal and medical) classes
in Canada.

Refugees
Generally a person must apply for an immigrant visa prior
to arriving in Canada. However, there are exceptions to the
general rule. One of these exceptions is the Convention refugee.
Persons in Canada who are determined to be Convention refugees
may apply for permanent residence within Canada.
Who
They are persons who are outside their country of citizenship
or habitual residence and, by reason of a well-founded fear
of persecution, for reasons of:
- race
- religion
- nationality
- political opinion or
- membership in a particular social group
- are unable or unwilling to return to their home country.
How
A person seeking Convention refugee status makes a claim
either at a port-of-entry (e.g. airport) or by attending at
a Canada Immigration Centre in Canada and notifying an Immigration
Officer of the intention to make the claim. Convention refugee
claimants are issued removal orders that do not come into
force unless their claim is refused.
Immigration officers decide if a claim should be referred
to the Refugee Protection Division for a refugee hearing.
At this hearing, the person claiming Convention refugee status
has the burden of proving that there is more than a mere possibility
that he or she would be persecuted for one or more of the
five reasons set out above. Successful determination leads
to conferral of Convention refugee status and the right to
apply for permanent residence.
If the Refugee Protection Division determines that someone
is not in need of protection, or that a claim is withdrawn
or abandoned, then that person must leave Canada.
